Ask the Small Claims Court to Order Financial Disclosure
This Motion for Financial Disclosure Hearing form asks the court to order the other party to provide more information about their financial situation. You should only use this form after you won a small claims judgment from the court and it’s been more than 30 days without being paid.
You should use this form if:
- you have an order from small claims court that says another person or business has to pay you money, and
- it has been more than 30 days since the judgment and you have not been paid, and
- you want to ask the court to enforce the order.
After accepting your motion, the court sends a form to the other party to ask for their financial information. The court sets a hearing to determine if and how the money can be collected from the other party. You can attend this hearing. At the hearing, you may find out that the other party has income that the court can’t garnish or collect, such as Social Security or other public benefits. The hearing will help you decide whether it is worth continuing to try to collect the money.
If you don’t have a judgment yet and you want to sue someone, do not use this form.

- a copy of the judgment from the court
- the name and address of the person or company that owes you money
- the amount of money you are owed
